General Terms and conditions of sale in store

ARTICLE 1. OUR COMMERCIAL POLICY

Bonpoint sells products in its boutiques as a retailer exclusively to consumers, end customers, hereinafter referred to as the “Customer.”

Bonpoint refers to Bonpoint Rive Droite, a simplified joint-stock company, registered under 348 890 476 R.C.S. Paris, with its registered office at 62 avenue d’Iéna, 75116 PARIS.

The Customer is defined as any natural person who does not act for professional purposes or related to a business activity. Considering the commercial policy described above, Bonpoint reserves the right not to process orders from entities other than the Customer as defined above or from orders that do not comply with its commercial policy.

These General Terms and Conditions of Sale (hereinafter “GTC”) exclusively govern any direct sale made in Bonpoint boutiques, excluding any other document specific to the e-commerce site or other sales channels.

Any sales contract between the Customer and Bonpoint concluded in a Bonpoint boutique is governed by these GTC, which the Customer acknowledges and accepts, without the sales contract being conditioned on a handwritten signature from the Customer.

 

ARTICLE 2. PURCHASE IN BONPOINT BOUTIQUES

Products offered for sale are those available in-store or in stock on the day of the Customer’s visit, subject to availability.

Products are presented to consumers, and store staff provide additional information and a complete description of their essential characteristics.

The Customer is also offered the possibility to place an order by phone with their usual store or to reserve a product online and collect it in-store within the indicated availability period. In such cases, the terms and conditions of the e-commerce site bonpoint.com, which are always accessible online and specific to distance sales, remain applicable between the Parties.

Products are not intended for resale.

 

ARTICLE 3. PRODUCT INFORMATION

Within its Bonpoint sales network, only luxury and top-quality products are sold. These products are purchased directly by Bonpoint from fashion houses, producers, and carefully selected resellers for their rigorous quality controls.

Bonpoint does not sell second-hand, defective, or substandard products.

Product prices are fixed. The current price is indicated on the products themselves. These prices include the VAT applicable on the day of the order. Any packaging and delivery charges may be billed separately and, if so, will be specified to the Customer during the purchase process. Their amount is fixed and flat-rate. 

Bonpoint reserves the right, which the Customer accepts, to modify its prices at any time, simply by updating the product labels. However, such modifications will not affect purchases already made, subject to the availability of the ordered products.

All products come with an identification tag. In case of a return, as stated in Article 5 below, it is imperative that the tag and single-use seal of the products remain intact.

If the Customer wishes to request an exchange, Bonpoint may refuse to accept any product that is missing its tag, has been altered in its essential or qualitative characteristics, or has been damaged.

 

ARTICLE 4. PAYMENTS

For payment of the product price and any associated services, boutique staff assist the Customer with all necessary information. Only cash payments, Bonpoint vouchers, or credit/debit cards are accepted. Checks are not accepted.

When paying by credit/debit card, financial information (e.g., card number or expiration date) is transmitted via an encrypted protocol to the bank, providing remote electronic payment services, without third parties having access. Such information is never used by Bonpoint except to complete purchase procedures or to issue refunds if products are returned under the right of withdrawal or to prevent/report fraud. Bonpoint never stores your banking information. Bank transmissions are encrypted and secure.

When ordering by phone, the Customer may be asked to connect via a secure link to make the payment. Data is transmitted directly to Bonpoint’s banking service provider, who does not receive the Customer’s payment information. The terms and conditions of bonpoint.com apply.

The Customer is advised to keep their store receipt or invoice.

 

ARTICLE 5. EXCHANGES AND RETURNS

In accordance with Article L.221-18 of the French Consumer Code, the Customer has 14 full days to return the ordered product(s). Bonpoint extends this period to 30 days for items purchased in-store. This period starts from the day of purchase or delivery of products to the originating Bonpoint store in the case of distance sales (excluding department stores). Each product must be returned intact, clean, and complete, in its original packaging (including any gift or special packaging, pouch, tag, identification label, or single-use seal if applicable).

All returned products are inspected. Any returned product that is incomplete, damaged, worn, or dirty will not be accepted and may, at Bonpoint’s discretion, be returned to the Customer at their expense or retained.

Unsealed perfumes and skincare products (cleaning gel and scented detergent) and unsealed boxes are not accepted. Personalized items or services will not be accepted or exchanged (e.g., personalized ribbon, embroidery, engraving, gilding).

A store credit will be issued if an exchange is not possible.

ARTICLE 6. PRODUCT WARRANTY

The Customer benefits from the conformity warranty under Articles L217-3 and following of the Consumer Code, as well as the legal warranty against hidden defects, under Articles 1641 to 1649 of the French Civil Code.

Legal warranty of conformity:

  • The Customer has two (2) years from delivery to take action.
  • The Customer may choose between repair or replacement, unless one option imposes a manifestly disproportionate cost for Bonpoint.
  • Compliance is provided free of charge.
  • If repair or replacement is impossible, the Customer may obtain a price reduction or cancellation of the sale.
  • The Customer is exempt from proving the lack of conformity during the 24 months following delivery.

Legal warranty against hidden defects: 

  • Article 1641: The seller is liable for hidden defects making the product unsuitable for its intended use or significantly reducing its use.
  • Article 1642: The seller is not liable for apparent defects the buyer could have noticed.
  • Article 1643: The seller is liable for hidden defects even if unknown unless otherwise stipulated.
  • Article 1644: The buyer may return the product for a refund or keep it and receive partial compensation.
  • Article 1645–1648: Additional provisions regarding seller liability and time limits for claims (2 years from discovery).

No additional commercial warranty is provided by Bonpoint beyond the legal warranties above.

Items purchased in Bonpoint Outlet stores or from resellers are not refundable, exchangeable, or subject to after-sales service.

 

ARTICLE 7. PERSONAL DATA

Providing personal data for customer registration is mandatory, as it is required for processing and delivering orders and issuing invoices.

ARTICLE 8. INTELLECTUAL PROPERTY

All intellectual property rights related to products sold by Bonpoint remain the exclusive property of Bonpoint. No one may reproduce, exploit, distribute, or use these rights without prior written consent. Bonpoint trademarks and logos are registered trademarks. Any reproduction constitutes counterfeiting.

 

ARTICLE 9. MISCELLANEOUS PROVISIONS

Ownership of products transfers to the Customer only after full payment. Risks (loss, theft, or damage) are assumed by the Customer upon receipt.

Bonpoint is not liable for partial or total non-performance caused by a force majeure event, as recognized by French law, which makes performance impossible. Bonpoint will inform the Customer and propose alternatives. Such events suspend or terminate Bonpoint’s obligations without compensation.

Bonpoint archives orders and payment receipts on a reliable and durable medium. Electronic records are considered proof of communications, orders, payments, and transactions. Electronic correspondence is presumed to have the same evidentiary value as paper documents.

If any provision of these GTC is invalid under applicable law or court decision, it shall be deemed unwritten without affecting the contract’s validity or other provisions.

 

ARTICLE 10. APPLICABLE LAW – CLAIMS

Sales in Bonpoint boutiques and these GTC are governed by French law.

Otherwise, the competent courts are those of the Customer’s place of residence.
